1. Acceptance of Terms

By creating an account or using the Avenix Data web application at avenixdata.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Avenix Data provides an end-of-day stock screener covering the S&P 500 universe. The Service includes:

• Daily market data scans (price, volume, 52-week ranges)
• Short interest data and Reg SHO threshold tracking
• Dilution analysis via SEC EDGAR filings
• On-demand research report generation
• Tiered access: Free, General, and Pro

The Service is provided on an "as is" basis and is intended for informational and research purposes only.

3. Not Financial Advice

• All data presented is sourced from third-party providers (Marketstack, SEC EDGAR, FINRA) and may contain errors or delays
• Short interest, dilution, and other metrics are point-in-time snapshots, not real-time data
• Nothing on this platform is a recommendation to buy, sell, or hold any security
• You are solely responsible for your own investment decisions
• Always consult a licensed financial advisor before making investment decisions

4. Account Registration

• You must provide a valid email address and password to create an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account
• One account per person — sharing accounts is prohibited
• You agree not to use the Service for any unlawful purpose

5. Subscription Tiers

The Service offers three public subscription tiers:

• Free: Access to base market data (price, volume, sparklines, day high/low)
• General: Adds flag pills (dilution/SHO alerts), short interest data, and SI chart overlay
• Pro: Adds dilution analysis, Reg SHO threshold tracking, and on-demand report generation

Tier features and pricing may change at any time. Paid subscriptions are billed through Stripe and may be cancelled at any time. Refunds are handled on a case-by-case basis — contact [email protected].

6. Acceptable Use

You agree NOT to:

• Scrape, crawl, or bulk-download data from the Service for redistribution
• Reverse engineer, decompile, or attempt to extract the source code of the application
• Use automated scripts, bots, or crawlers to access the Service without written permission
• Share, resell, or redistribute reports or data obtained through the Service
• Use the Service to violate any law or regulation
• Attempt to circumvent tier restrictions or access controls

7. Intellectual Property

• The Avenix Data application, including its design, branding, and user interface, is the property of Avenix Data
• Market data displayed on the Service is sourced from third-party providers and is subject to their respective terms
• Generated reports are for your personal use only and may not be redistributed commercially
• The Service's source code is publicly available under an open-source license — see our Privacy Policy for details

8. Data Accuracy Disclaimer

While we strive for accuracy, we do not guarantee that:

• All data is accurate, complete, or current
• The Service will be available at all times without interruption
• Generated reports will be free of errors
• Market data will match real-time or official exchange data

Market data is sourced from Marketstack (end-of-day), SEC EDGAR (filings), and FINRA (short interest). Each provider has its own data collection methodology and update frequency.

9. Limitation of Liability

To the maximum extent permitted by law:

• Avenix Data shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service
• Avenix Data shall not be liable for any financial losses resulting from investment decisions made based on data from the Service
• Avenix Data shall not be liable for any data inaccuracies, service interruptions, or third-party provider failures
• You use the Service at your own risk

10. Indemnification

You agree to indemnify and hold harmless Avenix Data and its operators from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.

11. Service Modifications

• We reserve the right to modify, suspend, or discontinue the Service (or any feature) at any time
• We will provide reasonable notice for material changes to paid features
• We are not liable for any modification, suspension, or discontinuance of the Service

12. Account Termination

• You may delete your account at any time by contacting [email protected]
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your session tokens will be revoked immediately
• Account data will be deleted upon request

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the jurisdiction where Avenix Data operates, without regard to conflict of law principles.

14. Changes to These Terms

• We may update these Terms at any time by posting a revised version on this page
• We will update the "Last updated" date at the top of this page when changes are made
• Material changes will be announced on the application dashboard
• Continued use of the Service after changes constitutes acceptance of the updated Terms
